Brant Associates have considerable experience in representing Parties in Adjudications, whether as the referring or responding party.

Trevor Brant has acted as Adjudicator, and is named as the appointed Adjudicator in a number of Contractor's Sub-Contracts.

We recognise and respond to the importance for clear, concise, and well presented referrals.

Equally we understand and react to the urgent response needed when a receiving party is "ambushed" by an unexpected referral.

Adjudication is often "quick and rough" justice. It is considered to be an interim position prior to Arbitration or Litigation. It is therefore important to obtain the right result and negate the need for further proceedings.

Considerations

In considering whether to promote Adjudication procedures, or when faced with a Referral it is important to establish the following:

  • Is there a written contract?
  • Is the Contract a Construction Contract as defined by the Housing Grants Construction and Regeneration Act 1996?
  • Has a dispute crystalised?
  • Does the appointed Adjudicator have jurisdiction?
